You can use this information not only for sacking corporate executives, but also for terminating partners and trusted lieutenants in small businesses. So, have your Personnel boss or employment lawyer review your separation settlement to be sure it complies with state laws. Should You Continue With A High-Risk Termination? Since the employer looks to the Human resources professional as the expert, it's important for the professional to be knowledgeable about separation procedures, business policies, anger management and exit interviewing skills. You've likely hired a replacement and are ready to move forward with the new worker. This means any layoff involving a 40 and over worker is going to be a medium risk at best. While it may not suit your culture or sensibilities to have a Hare Krishna among your staff, if he performs his job well, there is no legal reason for you to separate him. You get the insubordinate employee out of the building with little disruption, and you don't have to worry about a half-million dollar lawsuit. Please don't use use 'downsizing' as an excuse for separating bad employees, or creating a culture change in the department by replacing old workers with new ones.
